EmPowerBall Football League Programme - Terms and Conditions

Welcome to the EmPowerBall Football League Programme! Our mission is to promote physical activity, social interaction, and mental well-being through football. By registering and participating in our programme, you agree to abide by the following Terms and Conditions, designed to ensure a safe, inclusive, and supportive environment for all players.

1. Eligibility and Registration

1.1 Age Requirement
  • All participants must be at least 18 years old at the time of registration.
1.2 Registration Process
  • To participate, individuals must complete the official registration form with accurate and up-to-date information.
  • Participants must notify organisers of any changes to their contact information.
1.3 Health Declaration
  • By registering, participants confirm that they are physically and mentally fit to engage in football activities.
  • It is the player’s responsibility to assess their health condition before participating. If unsure, they should seek medical advice before joining.

2. Programme Goals and Mental Health Support

2.1 Purpose of the Programme
  • EmPowerBall is more than just football; it is designed to enhance well-being, build friendships, and encourage positive mental health through regular physical activity.
2.2 Mental Health Initiatives
  • Participants are encouraged to engage in mental health initiatives offered through the programme, such as:
    • Regular check-ins to support player well-being.
    • Access to support resources and signposting to professional mental health services.
  • Participation in these initiatives is optional but highly encouraged to promote a holistic approach to well-being.

3. Code of Conduct

All players are expected to uphold a respectful, supportive, and inclusive community. The full code of conduct can be found HERE and forms part of these Terms and conditions.

3.1 Respect and Inclusivity
  • Discrimination, harassment, bullying, or any form of disrespectful behaviour will not be tolerated and may result in removal from the programme.
  • Players must respect teammates, opponents, referees, and organisers at all times.
3.2 Team and Community Support
  • Participants should support and encourage each other, both on and off the field.
  • A culture of positivity, teamwork, and inclusion is key to the success of the programme.
3.3 Mental Health Awareness
  • Players are encouraged to be understanding and open-minded about mental health discussions and activities.
  • Respect others’ personal experiences and be mindful when discussing sensitive topics.

4. Participation Rules

4.1 Attendance and Commitment
  • Regular attendance is expected to ensure fairness and consistency for all teams.
  • If a player is unable to attend a scheduled match, they must notify their team or organisers as early as possible to allow for team adjustments.
4.2 Health and Safety Responsibilities
  • Participants must take responsibility for their own physical and mental well-being and report any health concerns to organisers.
  • Injuries or medical conditions that may affect participation should be disclosed to organisers before playing.
4.3 Medical Assistance
  • In case of injury or a mental health concern, participants should seek appropriate medical or therapeutic support.
  • While EmPowerBall is not a substitute for professional healthcare.

5. Liability

5.1 Personal Responsibility
  • Participation in the EmPowerBall Football League Programme is at the player’s own risk.
  • The organisers or venues are not liable for any injuries, damages, or losses sustained during participation.
5.2 Insurance
  • Players are advised to have personal health and accident insurance to cover any potential injuries or incidents.
5.3 Mental Health Support Disclaimer
  • While EmPowerBall promotes mental well-being, it is not a professional mental health service.
  • Participants with significant mental health concerns should seek professional support where necessary.

6. Weather Policy and Game Cancellations

6.1 Playing in Different Weather Conditions
  • EmPowerBall matches are played rain or shine unless extreme weather conditions make play unsafe.
6.2 Venue Closures
  • If the venue is forced to close due to extreme weather or unforeseen circumstances, players will receive a credit towards a future game.
  • The league will not issue refunds but will make every effort to reschedule or provide fair compensation in cases of cancellations.

7. Team Availability and Injuries

7.1 Team Shortages
  • If a team is short on players, substitute players from other teams may step in to ensure matches go ahead.
  • Players are encouraged to remain flexible and collaborative to keep games running smoothly.
7.2 Injury Policy
  • If a player suffers an injury that prevents them from playing for an extended period, they should inform the organisers.
  • While membership fees remain unchanged, organisers may consider individual circumstances and offer alternative arrangements where appropriate.

8. Data Protection and Confidentiality

8.1 Handling of Personal Data
  • Personal data collected during registration will be stored securely and used only for the administration of the programme.
  • Data will be processed in accordance with our Privacy Policy.
8.2 Confidentiality in Mental Health Discussions
  • Any information shared in mental health workshops, group discussions, or support sessions will remain confidential.
  • While organisers will uphold confidentiality, participants are also expected to respect each other’s privacy.

9. Payments, Fees, and Refund Policy

9.1 Subscription and Membership Fees
  • Participation in the EmPowerBall Football League Programme requires a monthly membership fee.
  • This fee covers access to matches, league administration, and additional programme benefits such as the Wellness Hub.
  • Payments are collected on a recurring monthly basis through the chosen payment method at registration.
9.2 Payment Methods
  • Accepted payment methods include credit/debit card, or other online payment services via Stripe.
  • Payments must be made in full and on time to ensure continued participation in the programme.
  • Failure to complete payment may result in suspension from matches until the outstanding balance is cleared.
9.3 No Refunds Policy
  • The membership fee operates on a subscription basis. As such, no refunds will be provided for:

    • Missed games due to personal reasons, holidays, or short-term injuries.
    • Matches played in poor weather conditions, unless the venue is forced to close.
    • Situations where a player is unable to attend due to team shortages (as alternative solutions will be arranged).
  • If a player suffers a long-term injury that prevents participation, they should inform the organisers, who will assess the situation on a case-by-case basis.

9.4 Weather and Cancellations Policy
  • Matches will not be cancelled due to bad weather, except in extreme conditions where the venue itself is closed.
  • In the rare case of venue closure, players will receive a credit towards a future game.
  • Refunds will not be issued for cancellations due to reasons beyond the organiser’s control.
9.5 Subscription Cancellation
  • Players may cancel their membership at any time by notifying the organisers.
  • The cancellation will take effect at the end of the current billing cycle, meaning players can continue participating until their paid period expires.
  • Partial refunds for unused portions of the subscription will not be granted.
9.6 Financial Hardship Considerations
  • We recognise that financial hardship may affect some players. If a participant is struggling to make payments, we encourage them to reach out confidentially to discuss potential support options.
  • The organisers may consider temporary payment pauses or alternative solutions, at their discretion, to ensure accessibility for all.

10. Termination of Participation

10.1 Voluntary Withdrawal
  • Players may withdraw from the programme at any time by notifying the organisers.
  • Refunds for membership fees are not available, but players may use their membership until the end of the paid period.
10.2 Removal from the Programme
  • The organisers reserve the right to remove any participant who:
    • Fails to adhere to the Code of Conduct.
    • Engages in behaviour that disrupts the positive environment of the programme.
    • Commits acts of disrespect, discrimination, or misconduct.

11. Competing Business & Conflict of Interest Policy

11.1 Participation and Business Interests
  • The EmPowerBall Football League Programme is designed to create an inclusive and supportive community for all participants. While we welcome individuals from all backgrounds, we also aim to protect the integrity and sustainability of our programme.
  • Individuals or organisations involved in competing football leagues, fitness programmes, or similar sports-based initiatives are not permitted to use EmPowerBall for commercial, recruitment, or promotional purposes.
11.2 Prohibited Activities

Participants, spectators, or businesses associated with competing organisations must not:

  • Promote or advertise any competing football leagues, training programmes, or community initiatives within EmPowerBall events, online platforms, or communication channels.
  • Recruit or solicit players for competing businesses while attending EmPowerBall matches or activities.
  • Use EmPowerBall events to conduct market research for similar or competing initiatives.
  • Attempt to replicate or mirror EmPowerBall’s structure, services, or unique programme aspects for commercial gain.
11.3 Business Collaboration & Sponsorship Opportunities
  • If a business or organisation wishes to collaborate, sponsor, or partner with EmPowerBall, they must seek written permission from the organisers.
  • All business-related discussions should be directed through official EmPowerBall representatives.
11.4 Breach of Policy & Legal Recourse
  • Any participant found violating this policy may be subject to immediate removal from the programme and may be permanently banned from participation.
  • The organisers reserve the right to deny access to any individual or business that conflicts with the core objectives of EmPowerBall.
  • We reserve the right to seek damages equal to the costs incurred in pursuing a claim against you, including but not limited to legal fees, investigative costs, and any loss of earnings suffered as a result of your actions.

By registering for the EmPowerBall Football League Programme, you acknowledge and agree to these terms regarding competing businesses and conflicts of interest.

13. Mental Wellness App – Terms & Conditions

  • Third-Party Provider
    As part of your EmPowerBall subscription, you receive access to a mental wellness app operated by Social Value Company. This app is provided independently, and EmPowerBall is not responsible for its content, functionality, or availability.
  • Access & Eligibility
    Access to the mental wellness app is included in your subscription; however, usage is subject to Social Value Company’s own Terms & Conditions and Privacy Policy. By using the app, you agree to comply with their policies, which may differ from EmPowerBall’s.
  • Privacy & Data Protection
    Any personal data provided within the mental wellness app is managed by Social Value Company under their own Privacy Policy. EmPowerBall does not collect, store, or have access to this data. We encourage users to review Social Value Company’s Privacy Policy before using the app.
  • Health & Wellbeing Disclaimer
    The mental wellness app is designed for general wellbeing support and is not a substitute for professional medical advice, diagnosis, or treatment. If you have concerns about your mental health, please seek guidance from a qualified healthcare professional.
  • Service Availability & Changes
    Access to the app is offered as part of your subscription; however, EmPowerBall reserves the right to modify, replace, or discontinue access to the app at any time. Social Value Company also maintains control over the app’s availability and functionality.
  • User Responsibility
    While using the mental wellness app, users must comply with Social Value Company’s Terms & Conditions. Any misuse or breach of their policies may result in restricted access. EmPowerBall is not liable for actions taken by Social Value Company regarding app usage.
  • Liability Limitation
    EmPowerBall is not responsible for any direct, indirect, or consequential loss resulting from the use of the mental wellness app. Any concerns regarding app performance or content should be directed to Social Value Company.

13. Amendments to Terms and Conditions

  • The organisers reserve the right to update these terms and conditions at any time.
  • Participants will be informed of any changes that may impact their membership or participation.

By registering for the EmPowerBall Football League Programme, you acknowledge that you have read, understood, and agree to comply with these Terms and Conditions.
